One-year extension for the small-sized plots outside the city plans, to ensure the possibility of building.

Significant development has recently taken place in the matter of building off-plan plots with an area of less than 4,000 square meters.

The new legal framework for the plots outside the city plans impacts several plots' possibility to build; the properties of interest are those with surfaces: 750, 1,200, 2,000, and up to 4,000 sqm.

Specifically, according to a press release by the Ministry of Environment and Energy (click here to see it), a one-year extension is given to plots outside the city plans that their size and access are not in compliance with the standard requirements and for which a building permit will not have been issued until 9 Dec 22.

With the legislative regulation that will be issued in the next period, the said fields will have the possibility to be built only if, until 9 Dec 22, the interested owners choose to take one of the following actions:

  • Apply for the issuance of a pre-approval building permit. In this case, all supporting documents and studies defined by law must be submitted together with the application.
  • Apply for issuing a certificate of land zoning terms and conditions. For the application to be complete, the following supporting documents must be submitted by a competent engineer:
  1. topographical plan and
  2. recent certificate of ownership (contract, property registration certificate to the cadastral or the land registry office).

In this case, the use of the land zoning terms certificate will only be possible until September 30, 2023, and until then, either a request for a building permit or pre-approval must be submitted.

Suppose the submission of a pre-approval application is chosen; in that case, nobody, public service, or collective body approval is required due to the location of the project, its nature, its use, or any unique characteristics.

Likewise, it is not required to submit the approvals of agencies, services, or collective bodies to obtain the land zoning terms certificate.

The above procedures are simple, but they can be implemented by those owners who have done preparatory work with their property documentation, mainly as regards the topographical plan as per current specifications.

Those who decide to start the effort now will probably miss the irrevocable date of 9 Dec 22.
